Have to watch this one carefully. Kennedy (one of the co-sponsors of this bill) had thrown EB immigrants under the bus last year while favoring FB and illegals (in CIR). Need to be see the contents of this bill very carefully. Esp this clause from the AILA report:
"Addressing the decades-long backlogs for certain countries by raising the per-country immigration limits from 7 percent to 10 percent of total admission".
The CIR in 2007 had a similar clause, bumping up the country-limit from 7% to 10%, BUT it had another related clause that stopped rollover of visa's in the last quarter.
That would be disastrous for people from India and China as number of visas issued for the whole year will go DOWN!!
The recapture clause sounds promising , provided there is atleast an even split between EB and FB (of EB coming before FB). If they do it the other way around (like they had done in the last recapture for schedule-A nurses) then EB people will see no benefit of the recapture, and will end up losing one more quick-fix option.
Eagerly waiting for the bill text so the dissection and analysis can begin!!

Oh wait. I get it now. We're probably mistaken in thinking anand26's idea is to improve IV; looks like the idea is to promote "yelling at people" as a way of life.
The plan is to do nothing oneself but make a random to-do list for other people; so we should also respond in the same spirit.
Here are some things you should do, anand26; now do it quickly and report back to this forum by tomorrw:

Ok, if advertising is too far-fetched, then hold some cultural events and make money on those. Brainstorm with members to find other ways to make money. People are not going to contribute. That is the writing on the wall. There is lack of trust and lack of faith in IV. IV will have to figure out ways to generate cash from other things than member contributions. If I remember correctly, people contributed nearly $200K and have got nothing to show for that.
These suggestions are because you think money is the issue. I don't think it is. It's the lack of good leadership. That is my opinion and it was point of my original posting. Lack of money is being blamed wrongly. But may be I am wrong.
Attack my ideas and not me. Then we can have a debate conducive to achieving our goals.

That is already happening in state chapters. In my opinion IV still has a need to remain "grass root" organization. And as long as that is needed, "Recurring Contribution" would be more attractive tool. Once we set "Paid membership" concept it will instituionalize and in my opinion at this early stage it is not
advisable.

Agreed that this will throw out all the crappy body shoppers. This is what we need in future not to make it difficult for future h1-b or other people. We should infact support this bill as this will weed out many Indian Body shoppers and benefit everyone.
This is nothing new but most of it is just implementing what is already in low. Thats my take on it.

In reality, many companies who have subsidiaries abroad can use L1 visa program. But H1B offers flexibility that is much desired by many companies. (It is very less abused compared to H1B). No numerical cap on L1B may not go well with many of us. But I am very +ve that the visas are not issued in anticipatory mode like H1B. And why do companies spend 5K if they do not want to get the worker here? Do they like waste money just like that?
Logically this highlights the real problem in the system - numerical caps. If the caps are not there and companies can get a visa-on demand, they will not spend 5K per visa on anticipatory mode. Because there is no need to do that.
So no system is perfect. We have to minimize abuse and act responsibly when it comes to sensitive issues like immigration...
I see only one problem in this logic! Many cases I know of, at least from the 2007 H1B fiasco, paid for the H1Bs through consulting companies FROM THEIR POCKETS. So to answer your question as to why companies would spend $5000 in anticipation, is that they don't. They take it from the applicant. (again I am not saying all do, but there are abusive companies that do).
No cap on visa numbers will never fly... No political environment will be conducive to bringing in unlimited foreign workers without any restrictions. L1 has no caps because it is very difficult to qualify for an L1 visa, as far as I know. If caps in H1 are removed, you can bet there will be severe restrictions imposed on other aspects of the program.

We the H1Bs are the victims of the this system. We did not create this system. It is true that there are social costs associated with this system. Abolishing the system is not the solution. Reform and making the system just is the solution..That is all we are asking for....

I disagree with you. Last many H1-B petitions have denied on these grounds. Memo just made the current interpretation as public knowledge. Read the denial cases by and you will see what I am taking about.
It seems that AILA is making noise since this memo is going to hurt the business of their members.

Technically the lawyer is correct. However, it is very difficult to show actual duties and job period for the beneficiary (H-1B worker) without the end-user client letter.

$50 is too high. I know big communication American company who bring people here on $35 per day. That is even below the minimum wages.
