USCIS would like to assure its customers that the delay in data entry and fee receipting will not affect Change of Status or Extension of Stay eligibility, assuming all other eligibility requirements are satisfied. USCIS would also like to assure its customers that per existing policies and procedures, requests for Premium Processing Service will continue to be processed within 15 days. USCIS wishes to assure all customers that the original received date (the date which the document is date stamped) will be honored and recorded on the receipt notice. This date will appear in the "Received Date" box on Form I-797, Notice of Action. The received date is different from the "Notice Date", which also appears on Form I-797. The Notice Date is the date the receipt notice was actually generated.

Not all professions can apply for H1Bs. You need to have specific skills that the US does NOT have. Someone on here had once posted that his wife could not work as a teacher although the school was ready to offer her a job, coz there is no H1B category for teachers. The H1B visa cannot help spouses in all professions. Hence my suggestion.
About how this will solve retrogression, IT WONT. My point is instead of trying to bring this retrogression beast down, maybe we should look at alternatives to work around it.

You need to restart ur GC process but you can keep ur PD (if not revoked) and get a 3 year extension immediately based on the Approved I-140.

Hi all,
I got a RFE for Ability to pay for My I140(EB-3, PD-Ap2003) from USCIS. After consultation I was suggested that I needed an expert opinion letter from an Independent CPA telling that company can pay me the salary stated in the ALC. Now I need a CPA who can analyze the financials of the company and a lawyer who can write the letter to defend this case. I was wondering if anyone here can provide the service for CPA analyzation or sample letter on how to address this issue.

You are already enjoying the benefit of filing 485/EAD/AP in July-07. Atleast be considerate towards people who contributed their time, energy and resources to - in lot of ways influence the outcome of July visa bulletin.

We are victims as well. From 2001 to 2005 were waiting for Labor, they processed applications from April 2001 for three years (!?) and started from April 2005 we are in FBI name check . Coworkers applying in 2007 getting GC. If there any action in NY, I will be happy to participate.

these uscis reps dont even know that the uscis reversed their visa bulletin. all they were told was they will be rejected and that is what they are reiterating. they do not even know that the people at service centers were asked to hold them back. they are just like a bunch of kids who were told

These are small regulations that agencies can do. But even for such changes, the time period to get it done is very long (several months to a year). At least DOL woke up and acted. It will still leave a door open for sellers to stay happy and able to substitute labor. However it is not easy to find a buyer of a LC in 45 days.
All these are small problems compared to retrogression. Labor substitution rule will not get any visible or any noticeable relief to us. We will continue to stay retrogressed and wait for another 10-15 years for our greencards. It is important for us to contnue to fight to end retrogression by getting a legislative change done. As long as members are there to support IV, the organization will use every means to get relief measures for all of us. The coming months are crucial to our struggle. We need to stay united and continue the effort of making this organization a formidable force on the hill. IV members writing negative comments on various forums or feel disheartened should know that to get even a smallest job done is not easy. They are not only harming the whole effort and making anti immigrants happy, but also harming themselves by hurting this cause. Sometimes it is sad to read such negatve comments when you know how hard it is to work with limited time, resources, manpower and lack of much needed motivation in members.
BTW In our recent efforts we did give anti-immigrants shivers down their spine. It can be seen from their posts on their sites and also the hate mails they write on our forum and send to core members. You dont see a lot of it because we moderate posts. We are not scared of anyone. All this has only made our resolve stronger to fight it out and fix the system.

Thanks to the poster who started this thread! He just beat me. Now, this is what we need to know from IV core. How much money did they collectively spend? We need to pay them back, right now! Now, we know what Aman spent, we would also like to know what other members spent. These are the options I can think of :
1. Make this a paid site for the first 3 months. $10 contribution from 20,000+ members would take us to $200,000 in 1 month. Roughly, calculating that the collective money spent by core and other members is $200,000, we would hit that mark in 1 month. The rest of the $400,000 that would be made in 2 months can be for lobbying efforts as the article mentioned that the goal is to get $250,000 more by the end of this year. Core members : Please do not feel 'guilty' for making this a paid site as it is a Non-profit organization. Every body is benefitting from all the sacrifices you have made.
2. From the fourth month onwards, let people decide upon their own how much they want to contribute. But, please allow me to express this idea. If it is going to be $10, $20 one-time contribution etc., we can convince more people (Friends) to contribute instead of $50 or $100. Any money is good money and we should not say no to smaller amounts.
Let us all unite together in making sure that the core team gets their money back. We don't want to feel guilty all throughout our lives.
I just made a miniscule contribution of $100 for the first time.

Just finished calling the offices of all the representatives listed for Phase 3. Took me about 15 min to complete it. Left a voice mail for congressman Calvert's office. They staff persons were all very polite and did note down the information and mentioned that they'll pass on the information.
Urging more members to call and keep the momentum going. I will try and ask some of my friends affected by GC to participate in this activity as well.

jsb - I received an email today from CRIS that they have issued an RFE on my I-485. I am EB-3 India September 7, 2007 I-485 filer with a PD of June-2005. Like you said, they do not consider country of chargeability until the case is all set to approve.
Otherwise, why would they touch a EB3-I case with PD of 2005.
I am not sure what are they looking for in FRE. I want to get out of this game now....one way or the other!
Your situation confirms what I believe. They touched your file, because in the sequence of paper file receiving, your file is next. While issuing RFE, adjudicator did not even look at your PD or chargeability. When it is all clear, then perhaps they will open the page where PD and birth country are written. If at that moment in time your PD is current you will be cleared, else back to same (or some other) pending stack of files.
RFE could be for so many things, birth/medical certificates not acceptable, something is not properly signed, photos missing, passport photos not clear, etc.

We have to keep doing this... Senetor Obama mentioned 1 line about fixing Legal Immigration process, also both Senators mentioned that ILegal Immigrants will be last in the line of the process so that is a huge progress for us... These candidates have an army of people working for them, they do a lot of research go to forums, go to debate websites to see what are the pain-points, if we can get our questions in top 10 in every debate now on then Legal immigration will be in the spot light, that is half the battle won... regardless who is chosen by voters they will all have legal immigration on their agenda.
