Here is what ron gotcher has to say and zI think it makes sense.
don't have access to the raw data. I have spoken with personnel in the Visa Office and they have been unwilling to give out precise numbers. Rather, they have used phrases like "limited numbers" and "handful of numbers" to describe the situation.
I believe these assessments to be accurate. I base this belief on the certain knowledge that the CIS has more than enough pending China and India and India E2 cases to use up the remaining quota without having to advance cutoff dates at all.
If the CIS were processing enough cases to close out the quota, there would be absolutely need for the Visa Office to advance cutoff dates. Advancing cutoff dates if the CIS were processing enough cases to use up the quota would only result in more cases being filed than could be accommodated. There would be no point in doing this and, in fact, it would be contrary to established procedure. The only possible reason for advancing cutoff dates under present circumstances would be to allow consular posts to adjudicate more cases from their inventories.
Does this mean that the CIS is not going to approve any China or India E2 cases? Of course they will? They are a big agency and they are always adjudicating some cases. There is a difference, however, between adjudicating some cases and adjudicating a large number of cases. If they were adjudicating more than a few cases, or even likely to adjudicate more than a few cases, the VO would not have advanced cutoff dates. Doing so would have been positively harmful. The fact that VO did advance priority dates is the best evidence that the CIS is not processing enough cases to exhaust the quota.
The best evidence of this will be the establishment of the cutoff dates for the October Visa Bulletin. If the cutoff dates remain where they are, then that will be evidence that there are plenty of E2 numbers available for China and India. On the other hand, if cutoff dates for China and India E2 retrogress significantly in October, that will substantiate the position that there were only a few numbers (relatively speaking) available. If the cutoff dates retrogress, as the folks at the VO assure me they will, then that is conclusive evidence of the accuracy of this conclusion.

Sorry Guys I am asking this question in different threads , as I am unable to conclude any solution for this problem..:o
Let's assume B entered into US on Jan 1st 2004 with Visa stamping Valid till June 2006.
B doesn't have payslips for period of 185 days(aggregate) in his whole stay in US , rest of the time he maintains legal status , but he never travels outside US and applies for his 485 in March 2006.
In this case B is under risk of illegal status for more than 180 days , as he never travelled outside US.
OK agreed , when it's a law we should abide by them. But what are the other options available for B? He can't be covered under 245(K) so this option is ruled out.He needs to forget about GC? Will it be helpful if he contacts good lawyer any hope? Or just rely on luck?

There is a lot of work done in the background and by the state chapters that you may not be aware of. for example when i was a member of a state chapter a volunteer printed 5000 pamplets and we spent a weekend distributing them. One volunteer was actively involved in collecting and mailing out letters for the letter writing campaingn. there are some who visit every temple and talk about IV. These people dont post on the forums or beg for red, blue or green dots, they do the best they can. On the other hand many come to the forums with a 'grand plan' and hope someone else will doe the rest. Most are so self absorbed that they would rather spend time debating how their application is superior and how they should get GCs first. The same people end up volunteering each time while the rest demand answers and ask why bills are not passed. I can also give specific examples of people who posted that they participated in a campaign simply to get green dots. The final straw for me was the EB2 Vs EB3. Each person has his/her threshold, and i am positive that the core will feel the same way some day.
I am sorry to say this Pappu, but honestly I do feel one thing. There are some things that IV can do without spending money(which I think are not being done). For example, it can lead everybody everybody to send letters to USCIS and congressmen and the press for justice highlighting abrupt actions of USCIS. I made so many pamphlets in the thread "Lets get Organized" which can be sent alongwith to make an impact. It is not about eb2 or eb3, it is about accountability and transparency from USCIS. It does not involve any money from anybody excepting a 41 cents stamp on the letter which I think most of people should be ready to spend. However, the push from IV seems to be missing.

Hi all,
I have been following this thread and some posts suggest that the Observation on the passport for correcting the name is sufficient. Here is my situation:
My passport had the name as:
Surname: A***********
Given name: P****
The correct name should be (since this is how I use it in the US now and it applies to all my docs here - GC, DL, school records, everywhere).
Surname: P****
Given name: A***********
I got this corrected in the Indian passport through an "Observation" on Page 3 which states:
The name of the passport holder appearing on Page 1 has been corrected to read as:
Surname: P****
Given name: A***********
Since this is not a "name change" as such but simply a re-alignment of the last and first names (often a source of confusion from India), I hope this is sufficient and I don't have to go through a name change to get a new passport book issued.
Any comments would be greatly appreciated.
AP
Her name (First Last) was in the givenname on the passport and had the surname empty.
We went to NY consulate and wanted to add an observation, which they said no and issued her a new passport.
Now she has 2 passports.
I just wanted to ask everyone how does it affect her 485/EAD/AP application.
Thanks.

Thanks for the replies. I guess, I do not have time to get all that done before I file the I485. Damn, should have taken care of it earlier. I guess I will have to fill the forms just as I have done for the labor and then hope that I am not stuck. Will follow up with my lawyer to get some legal advice too. If I learn anything new, I will sure post.
Thanks again.
I am in the same boat as u r............... i have emailed my companies immigration dept and waiting to hear from them............. if u hear something from them, can u please share it here with us............... will really appreciate that.............

Hi all:
Thanks for all your advice and understanding. I could not post earlier as we were busy following up the case with the authorities. I have two lawyers on board and a wonderful, unexpected, child abuse NGO person helping us deal with the situation. Most importantly, the baby is in perfect condition after having everything scanned and reviewed with two pediatricians.it is possible, as one person helping us mentioned that the rough handling may appear exaggerated on the video bcos low resolution cameras sometimes exaggerate slower movements into sudden and forceful movements (I dont fully understand)- which is also ok w/ me as my child having been safe is more imp to me....at the minimum she will be deported and barred from entry, or likely fully convicted and behind bars...from what I have heard till now, we will likely not be penalized as there are some protection and immunities in these cases for those who testify (and most certainly INS will never be involved)and at most there may be some fines
....and to some others who have misread a few things I mentioned: a/ the baby did not remain with the nanny for even a second after we suspected something fishy b/ we were not saving money with this nanny: 350$ (plus food, commute, and phone cards is above average here even for a legal worker. Also we selected her after observing her (and earlier another nanny) at home for 2 weeks with the baby while my mom-in-law was there and all of us had felt for some reason that she was the better one..and to everybody with kids: no matter how much you trust your nanny, however well referenced they are- use a nannycam.you may amazed at what you see.there is something about having the whole house to yourself with an infant that makes some people crazy- so that their suppressed anger/envy and whatever else is hidden comes out on a poor speechless baby.
Happy ending. The End.

Hello guys,
Sorry for this non-immigration related post. We have this sudden, tragic situation that I wanted all of your advice on. Thank you for your time in reading this long post.
We had hired an Indian nanny in NJ who, we learnt after hiring her, is here on a tourist visa. We were paying her $350 per week cash, which is the standard rate around here for nannies (incl. citizens and people on GC). We had liked her when we met her in response to an ad on Sulekha, and we thought an Indian nanny would be good for our first child. She has been with us for about 3 months, and we were intermittently not getting a good feeling with her for some reason. We finally bought a small security camera and installed it yesterday. On the very first day with the camera, we came home and saw the recorded video to find that she is violently hitting the baby on two separate occasions. Needless to say, it has shocked, angered and extremely saddened us. I showed the video to a couple of friends and even they say it is unbearable to watch. This was just the first day of recording and it pains us tremendously to think what all may have happened previously.
She is of course not going to stay with the baby alone anymore, but I want to know what legal options I have to penalize her to the fullest extent, so that she does not do this to anybody else’s small babies. She it seems had come here last year and taken care of someone else’s baby in Hoboken, and I can imagine that their baby also went through this. (This woman and her husband are a ~ 35 year old couple, who have a multiple entry ten year tourist visa; both come here for 6 months every year and work odd jobs like this. They apparently got a (unsponsored) tourist visa after showing a lot of landed property in India).
I specifically want to know if I will have potential problems if I go to law enforcement about this- regarding have employed her (both of us are on H1B visas). I know we have made mistakes and should have done better due diligence in this, and there cannot be any more punishment for us than seeing our 8 month old – who cannot tell us about it when we come home- being beaten on the tapes. We saw this yesterday and have not told her yet. We want to weigh all options before we proceed, but from today onwards one of us is home all the time till Friday. Any advice or opinion is sincerely appreciated. Thanks for reading this long post. And, to all who are thinking of nannies or have one, please learn from our mistakes and closely monitor your child’s safety every day.
Thunderbold, Sorry for your situation. Here is my observation/suggestion.
Being an immigrant you have broken the law by hiring someone to work illegally. Didn't you and your wife break the law?
You have already witnessed a child abuse and now pondering whether to report this to a law enforcement or not. Again you are breaking the law by not reporting a child abuse. Remember, abetting a crime is also a crime.
This country has given us so much including good wealth and health(except GC) and we enjoy every thing, but in return what we do is to do these kind of illegal activities.
This country let us and our spouse to work, make hell lot of money. I am not saying we are making easy money, but after having two incomes, we run around with coupons and look for cheap things or do things that are cheap. WHY?
What are we going to do with that money man? This is nothing but a greediness.
Anyway, your child has gone thru a nightmare and as a parent/father you MUST report this to a law enforcement office. You can not let this child abuser go scot-free.
Note: When you can hire a nanny that is legal/citizen for $350/week, then why did you hire someone illegal?

Labor substitution may be legal but it is unethical. When everything depends on when you join the queue, how can one cut the line?
Whereas EB3 to EB2 porting is both legal and ethical. When you have a EB3 applicant that is waiting in line for 8 years, he/she had already gathered that much experience based on his long wait. Also, if you look at EB2, it is one of the highly abused category. The EB3 applicant who started in 2001 has joined the line half a decade before the one with 2006 Eb2 PD. One can't really accuse him/her for cutting the line just like one can about substitutes! If the EB3 porting case deserves merit, then I strongly support it!
My intention is not to to start a fight. But we need to see the true picture. Without acknowledging the problem how can we fix it?
Bottom line, GC abuses need to stop and we should fight for it as much as we fight for our rights to get GC!
As expected,I got a red dot on my post. And as usual, it was anonymous!
Pls. come out in open to share your views!

I would suggest not to go to COPS, if those folks are working any where else just call immigration authorities and report anonymously that they are working in USA illegally.
