    what do you mean by supporting IV?

    If you are talking about financial donations below model works best for me.

    lets say IV core comes up with COST of doing X,Y, Z fixes within XX weeks.
    COST is shared among wishing to donate. This becomes like a product purchase.

    Current model is not time bound nor result oriented.

    Again I am not anti-IV or anything. I am just expressing my idea!

    Unfortunately the system does not work that way. Let me ask you this. If you believed in being result oriented and time bound and made an investment to file your green card, when do you think the investment will pay off? Some things money can't buy, it takes tonnes and tonnes of energy to make a change. Believe in this organization and invest your time in helping this organization.

    Actively participate in all action items, mobilize your community, your state chapters. Spread awareness and build a sense of cohesiveness. Consider everyone here part of a family and remember everyone who works tirelessly work for all of us, not just them. Find out if there is anyway you can help, there are so many opportunities where IV needs all of us. Stand up, get up and move..

    Yes, after all the hard work there are things that may not work, but if we don't try, the system will not fix itself.

    This was the first time I participated in the event - I had no idea of what to expect and what can be achieved. I can honestly say that meeting all the people who attended the advocacy days showed me the dedication this group has and also realized that there was so much more to initiating laws and passing laws and how futile our arguments are on the forums regarding different categories in EB.

    In the meetings that I attended either the staff knew little about our problems (green card backlogs and legal immigration) or they knew of our problems and told us about the vast hurdles in the political environment that keeps popping up and derailing immigration reform. However, at no time the issue of EB1, EB2, or EB3 ever came up!! At the end of Monday, most of us met to share our experiences and as far as I can remember none of them mentioned it either. There was a lot of discussion on what the staffers wanted to know about IV and the solutions it was proposing. We were met with both understanding as well as skepticism - and I believe our job is to have more discussion with them and to make them see our point of view.

    Obviously we cannot be in DC to do this all the time, but I believe that we need to continue to keep in touch with these staffers as well as make repeated visits to the local district offices too. Two observations, many of the staffers wanted to know if we were from the district or the state that their offices represented - and even though IV tried to match this, we just lacked members from certain area, so fellow IVians, I request larger and wider participation in such efforts. Secondly, I have met with both my Rep as well as one of my Senators office locally, and when I mentioned it to the staffer in DC, she was very happy and was more receptive.

    I want to take this opportunity to Thank IV for opening my eyes to a world that I live in but never cared to understand. The road ahead for us immigrants is hard and long, but now I have started to pave the road with IV leadership. The question is will it be just few working hard and long? Or can we hope for better with 40,000 members?

    Ching is posting just what he experienced at the CIS office. Having said that, I am not saying what he posted has absolute truth to it. But on the otherhand, the way CIS does things, would anyone be surprised? With all the past experience we have had with CIS and DOS, anything is quite possible. Yeah, now it's not only frustrating to deal with CIS's ways of working, but also even more frustrating when we encounter posts like this whether they are true or not...

    Now I think some major clarifications are needed here. The Receipt Date (RD) that is printed on the I-485 receipt is the date whenever queuing according to RD is needed. This is THE date wherever a FIFO is required and is as assigned as soon as the envelope containing the I-485 is received.

    The ND only represents the date data-entry is made. This is the date which is mentioned erroneously as "received date" on the USCIS online system. Now this thing has been mentioned at USCIS liaison meetings by center directors and thro' AILA several times (I will post the reference as soon as I find it).

    That said whenever I talked to NSC officers (not the National Customer SC non-officers or regional call center IIO's or Infopass ignoramuses) ..officers who personally were aware of the going on's at the service center they said the Notice date does not carry any value for case adjudication priorities and the CLAIMS 3 systems only sequences (or sweeps as they call it) as per the PD and RD (when needed).

    Further, since I see all the notes made for my approved I-485 (thro' FOIA) including the worksheet completed by contractors. I clearly do not see any notations mentioned with reference to the ND on it...

    That said, for the OP, since your RD is very close to the "official" processing date there are all chances that your application might have already gone under the eyes of a CAO (Center Adjudication Officer). Call NSC directly and ask since you are so close and especially since your date is going current next month....you want to make sure that your file is either pre-adjudicated OR assigned to an officer.

    PD - Dec 2004 EB2

    My passport was renewed by Consulate of Chicago and the fields last name and first name were interchanged.

    I used the miscellaneous service form. The reason i gave was other and also did not fill my name on the form. I took it to the consulate along with my old passport and showed them the error. They agreed to make a correction and then I filled in the name on the miscellaneous service form the the way i wanted it to look like.

    They provided an endorsement on the second page of the passport and this should be good for travel and all other purposes. I did not need an affidavit as the old passport was used as the proof.

    I believe you should be able to use the same.

    This thread is good. Keep it going. I strongly recommend that - everyone active on thbis thread , please update your IV profile and also join a state chapter if you have not already done that. if you do not have a state chapter, contact your neighboring state chapters or if you want to start a state chapter, contact pappu or paskal and get permission to start one.

    It is very nice to see a lot of new mwmbers getting organized.

    Thanks a lot to all members for being with us in this struggle. We have tasted our first big success this year. Credit goes to each and every IV member. We were all affected by the visa bulletin fiasco and this is our victory. This is a victory for all our members and we must rejoice.

    IV had worked very hard and had been pushing for this in the background. Our flower campaign, rally and other advocacy efforts all came together and helped us at a crunch time. We thank members that sent flowers and also walked in the San Jose heat for 4 hours. All that really shows our commitment to this cause.

    We are happy that our efforts are successful and IV has been able to make a difference. Please also know that during this effort, IV was extremely active and decision makers heard our voice. We cannot give out all the details but what IV members should know is that these efforts should make each one of us proud and what we can do if we have a firm resolve. We were also the first to break this news even before anyone else or media could, and continued to update our members as time passed.

    04/06/2007: What Does Refund Checks from USCIS for FY 2008 H-1B Cap Filing Mean?

    There are a growing number of reports from the H-1B cap filers beginning from late yesterday that they started receiving "refund" of filing fees from the CSC or VSC. These are the cases of the petitioners whose filing fee checks have been cashed by the Service Centers. We do not know whether this news implies that the USCIS has completed the job of sorting-out and data-enties for all the cases and the random selection process has commenced. Assuming otherwise, one wonders how they have decided that these cases have been not selected and the filing fees should be refunded. There are two theories as to how the random selection would be conducted. Obviously, the entire cases should be data-entried before they can start a random selection process. Otherwise, the random selection process will be not scientic and too arbitrary. But no one knows. One theory is that in order to make the data entries, they should take the filing fees and the payment of these fees will have to be refunded for those which fail to make it. Other theory is that the checks will not be deposited until the selections are made. Currently the process of random selection remains a mystery. However, the fact that refund checks started being mailed out may indicate that the first theory is more likely than the second theory, and there is a possibility that the random selection is made by the computer during the process of data entry rather than after completion of data-entries of the entire cases. Since they had only opened and sorted out a little over 34,000 cases, it may be hard to believe that yesterday they could have completed sorting out of the entire remaining cases in one day.     Hi All,

    I recently had my last name added on my Passport. I just submitted for updating the SSN. Couple of questions:

    1. Does anybody know if I need to run the payroll and also file the taxes with new name on the SSN once it's been updated. I still need to file my 2009 taxes.

    2. Do I need to inform USCIS about this or it should be OK if I just submit the new name on I-129 when I apply for renewal later this year.

    3. I maintain H1B expiring Sept 2010. I might need to travel to India before expiration with the current visa. Do I need to do anything to avoid name confusion at POE?

    Please share your experience. Appreciate your time.

    North American naming conventions are clear, it has two essential parts, First Name and Last Name. Third part, the middle name is optional, and is also insisted upon, if you have one, to be written in full on all legal docs, such as PP, SS card etc.

    Addition of something to your name probably is not adding your last name. It is rather changing your last name, legally speaking.

    Therefore, this perhaps needs to be treated as a change of name, and you might need necessary legal docs to prove that, while trying to change for your taxes or other legal docs. Merely having a new passport with something added to your name, may or may not work.

    Hello guys,
    Sorry for this non-immigration related post. We have this sudden, tragic situation that I wanted all of your advice on. Thank you for your time in reading this long post.

    We had hired an Indian nanny in NJ who, we learnt after hiring her, is here on a tourist visa. We were paying her $350 per week cash, which is the standard rate around here for nannies (incl. citizens and people on GC). We had liked her when we met her in response to an ad on Sulekha, and we thought an Indian nanny would be good for our first child. She has been with us for about 3 months, and we were intermittently not getting a good feeling with her for some reason. We finally bought a small security camera and installed it yesterday. On the very first day with the camera, we came home and saw the recorded video to find that she is violently hitting the baby on two separate occasions. Needless to say, it has shocked, angered and extremely saddened us. I showed the video to a couple of friends and even they say it is unbearable to watch. This was just the first day of recording and it pains us tremendously to think what all may have happened previously.
    She is of course not going to stay with the baby alone anymore, but I want to know what legal options I have to penalize her to the fullest extent, so that she does not do this to anybody else’s small babies. She it seems had come here last year and taken care of someone else’s baby in Hoboken, and I can imagine that their baby also went through this. (This woman and her husband are a ~ 35 year old couple, who have a multiple entry ten year tourist visa; both come here for 6 months every year and work odd jobs like this. They apparently got a (unsponsored) tourist visa after showing a lot of landed property in India).
    I specifically want to know if I will have potential problems if I go to law enforcement about this- regarding have employed her (both of us are on H1B visas). I know we have made mistakes and should have done better due diligence in this, and there cannot be any more punishment for us than seeing our 8 month old – who cannot tell us about it when we come home- being beaten on the tapes. We saw this yesterday and have not told her yet. We want to weigh all options before we proceed, but from today onwards one of us is home all the time till Friday. Any advice or opinion is sincerely appreciated. Thanks for reading this long post. And, to all who are thinking of nannies or have one, please learn from our mistakes and closely monitor your child’s safety every day.

    Thunderbold, Sorry for your situation. Here is my observation/suggestion.

    Being an immigrant you have broken the law by hiring someone to work illegally. Didn't you and your wife break the law?

    You have already witnessed a child abuse and now pondering whether to report this to a law enforcement or not. Again you are breaking the law by not reporting a child abuse. Remember, abetting a crime is also a crime.

    This country has given us so much including good wealth and health(except GC) and we enjoy every thing, but in return what we do is to do these kind of illegal activities.

    This country let us and our spouse to work, make hell lot of money. I am not saying we are making easy money, but after having two incomes, we run around with coupons and look for cheap things or do things that are cheap. WHY?

    What are we going to do with that money man? This is nothing but a greediness.

    Anyway, your child has gone thru a nightmare and as a parent/father you MUST report this to a law enforcement office. You can not let this child abuser go scot-free.

    Note: When you can hire a nanny that is legal/citizen for $350/week, then why did you hire someone illegal?
