Guys,
Please refrain from fighting on EB3 and EB2 issue. We all know how difficult retrogression has been to every one here. As some one has already said, If interfiling was so easy and every one was fortunate enough to file another Labor/140, EB-2 would have been in 2002 or along with EB-3. AFAIK, Interfiling is some thing the law allows and as long as one does what the system allows and is not gaming the system, its perfectly fine. Don't rub salt on others wounds. Do what you can to improve the system. IMO, the backward movement was a knee jerk reaction to the false demand, shown by USCIS with a huge movement in PD. As you may know, this is purely demand and supply based DOS will move dates forward as soon as they realize that there is not much demand. DOS keeps track of all visa number requests and approvals based on PD's. The problem is DOS just does not know how many applications are pending per country per category to stop the back and forth movement of dates and make the date movement strictly forward. DOS clearly made this a requirement in OCT 08 bulletin and lets see what happens in the next few months. 2nd Q will be key as the over flow will start to trickle based on demand in EB-1+EB-4+EB-5

Why dont you call VFS and find out what's happening and if they can help you to resolve this?
I might have more information than VFS. The VFS agents don't know what's happening in the consulate. The agents doesn't know more than what is already present in the VFS website.

On March 30, my wife was issued a RFE for her incomplete medicals (TB test & Vaccination). Yesterday our attorney submitted the completed medical reports and today I received an email from 'CRIS' acknowleding the receipt of our response and resumption of the case. Checked the Online status and it also showed the today's LUD. Will keep the IV posted with any further development on our cases.
Here is the text of that email (seems very generic):

I am thankful to everyone who read or responded even if you don't agree. Taking it a step furthur there are couple of things that stand out which i think again show how we twist every fact to our advantage.
1) US need immigration to grow and prosper. wel agreed, but who are we to preach. Its for American to figure it out. We don't care for our mother land i:e India but we are first to point out how US will be worse off if it stops immigration. I really doubt the intention here. You know, we care more bout US then India and once we get our GC we probably wont care much bout US either.
2) Saying its a fight for rights and if we don't fight we are cowards. well i agree we are all cowards not because we are not fighting to bring forward all mighty priority dates but because we showed our backs to our own country. We went to public funded IIT and other institutions and then ran away from our nation at first chance. So yes, in a way we are all cowards here.
3) USCIS should be fair to India. If you look closely, USCIS rules are not country specific. Quota applies to every country, but only India, Mexico and china exhaust theirs. Does tell u something doesn't it.

Rep. Raul Grijalva said the measures will be introduced soon and would provide expedited citizenship for active duty military members who are not U.S. citizens, and permanent resident status for their families.
House Resolution 6020 would help some of the more than 45,000 noncitizens serving in the U.S. military as of March 2007, said Grijalva, a southern Arizona Democrat.
``Some families fear immediate deportation if their noncitizen soldier is killed on active duty,'' he said.
The bill would permit family members of such soldiers to become lawful permanent residents.
A second bill calls for basic health care for detained immigrants.
House Resolution 5950 would set medical care standards for immigrant detainees.
The secretary of the U.S. Department of Health Services would be required to establish procedures for the timely and effective delivery of health care to detainees and to report the deaths of detainees to the agency and Congress. It would require any necessary medications be provided upon detention.
Grijalva may not he done yet. The congressman said he is considering co-sponsoring two more immigration bills that have bipartisan support.
One eliminates the per country limits on foreign workers who can obtain employment-based visas to work in the United States.

Not sure I follow your argument here. Why should we not pursue the CIR and Recapture Bill action alert via AILA site. Also I am curious to know why IV has not put up a fax campaign for the same - given that this issue is clearly the focus on much of the IV agenda. Finally, I would think that while it is important to campaign directly to those in the know and power, as IV does and encourages members to do, there is something to be said for the strength of numbers. And one of the many ways IV can demonstrate that strength is not just to quote numbers in lobbying efforts but also to display direct interest of members and indeed non-members via faxes sent. IV Core and Donor Forum - some response from you would help us understand the path being pursued here.

Lots of bills with small provisions get talked up or introduced. In fact that happens every year if you look back. We keep an eye on what's moving and where the effort is needed. We do not want to waste our resources and effort if something may end up simply being a placeholder or a position statement.
In a nutshell, there will be fax campaign when we are advised (by lawmakers, lobbyists and friendly advocacy groups among others) and we determine that it is needed and will be effective.

As describe by you above scenario .how come even your fault when car 7 or all other front car come stand still or go below road posted speed. I would argue that car7 is the initiator and reason to disturb traffic not you even if hit from back side and cause ripple effect. I would say car7 is at major fault and you should defend your case and sue all upfront car drivers for not violating traffic rules and causing this much inconvenience.

So you guys are saying that because you are on a H1B you are working harder than others? Let me tell you that working hard does not guarantee your job. I have seen hard workers laid off left and right, be it US citizens, green card holders or H1Bs. In fact one of my GC friends said that it is a constant fear for him to be employed at all times, he was unemployed for 10 months after the dot com bust. That changed him completely, he said what will I do with my GC, can I feed my kids with a GC? I need a job. So it is everyone's perspective. I look at him and say at least you have a GC, he says at least you have a job. :)
Probably most of you are aware of these things. So, let me say this advice is for newbies in the job. Lay-offs are done for business reasons and cost considerations. An American friend of mine lost his managerial job after 18 years of loyalty and experience. Company did not see the reason to continue to be in that business and the entire division related to the business was laid off. So working hard is good. Definitely a deserved trait. Do it for self-satisfaction, but not out of fear of loosing the job. At the same time, we should not be cloistered within the company working long hours. There are other things imprtant in life apart from the eight hours we spend at the office. I tend to my hobbies to keep my sanity after work. I look out for business indicators/news regarding how my company is doing. Good financial planning mandates savings around 6-12 months of living expenses which would lessen the impact of lay-off.;)

This is real good discussion. I just wanted to know if anyone has travelled using AP multiple times. I just came back from Europe and used AP to reenter. I am still maintaining my H1B status, but I would like to travel to India again in December. I will be using AP again.

Ok Logiclife, i did not intend to start a war or anything of the sort. I was just giving suggestions in light of the fact that inspite of IV working VERY hard, nothing is happening on the GC front. That is the ONLY reason I put up this post.
One more thing. You mentioned that a lot of people are not contributing, maybe the reason is that not everyone wants a GC that desperately. Some people are fine with working here temporarily and then going back after making some money. Besides some members who have contributed in the past may be wondering if it even makes sense to contribute again, being that there has been no real progress on the GC front since Dec 2005 (the birth of IV). Now do not get me wrong I KNOW how hard the IV team has worked and how many time we came SO SO SO close to getting our dreams realized in the Senate only to be crushed in the house again.
My point was, maybe it is time to face the facts. The government has changed but the basic attitude towards the "immigrant" is the same. This is because the average American, views immigrants as a threat. Now we can argue all we want on that statement, but in our hearts we know that the "AVERAGE American" would rather Not have immigrants come to the US (legal or illegal). In light of these events does it not make sense to ask for simpler goals? Goals like 485 filing or H4 Eads etc. Sure it makes us look weak in front of the anti-immigrants, but then are we here to solve our problems or to prove the anti-immigrants wrong?
